I just returned from our Sudbury office. I am always happy to go there because while it is a big town you get that small town feel. People are extremely welcoming and friendly. Which is great but can often create a problem from a personal injury perspective. Far be it from me to criticize, but I do have a point.

Two-Year Limitation Period For Personal Injury Claims

We only have two years in this province to take action on a personal injury. In speaking to a lot of people out there who are seriously injured and in need of help I noticed the same theme which was I thought I would get better, I didn’t want to rock the boat or I thought it was no big deal. The mentality was not to complain, a mentality I appreciate and respect. However, we all need to be aware of our rights.

Often an injury will heal itself and it will become no big deal, but if it doesn’t and it lingers for over a year it could be chronic. Only a doctor can tell. My point is that there are a lot of limitation periods most people are not aware of and by not taking action they are not preparing themselves. The two year limitation is the big one. There are others equally as important. For example, you need to put the City on notice immediately. Seven days if it is an urban municipality and ten days in a county or township. You may not be sure which one your injury falls under. Also you have 30 days to apply for accident benefits after your motor vehicle accident.
