Pool Death Prompts Possible Legal Action

Parents want registration fees back!

A group of 10 parents are threatening legal action against a Vaughan camp – where a four-year-old was found unconscious on a pool – if staff refuse to refund them their registration fees.

The unnamed little girl was pulled from the pool Tuesday at Pavilion Fitness Club – Near Dufferin St. and Hwy. 407- and died in the hospital Friday morning.

No Negligence, No Refunds

The group of concerned parents claimed they were told by the Pavilion over the weekend, which runs the Kidz Klub drop-in camp, there would be no refunds issued because the staff were not negligent.

“Obviously, the parents have issues about sending their kids back to the camp,” said the families’ lawyer Sandra Zisckind, of the firm Diamond and Diamond.

The parents of the dead girl are not included in the group.

Zisckind said the group is waiting to hear from the camp directors before pursuing legal action.

“We’re waiting to see what occurs in the next week,” she said. “If they are going to refund the money to the parents and make any necessary compensation, then clearly a lawsuit isn’t necessary.”

The parents, who have children ranging in age between four and seven, are looking for compensation of $700 to $1,000.

A spokesman for Pavilion could not be reached Sunday. A receptionist who picked up the phone said no one would be available until Tuesday.

No charges have been laid in the case, police said Sunday.
