Monsanto Class Action Lawsuit: Roundup Cancer Risk

Have you contracted cancer as a result of your exposure to a weed killer by the name of Roundup? You may be entitled to compensation. Since May 2019, there have been thousands of Monsanto lawsuit claims filed which allege that the common Roundup weed killer sold by Monsanto’s parent company Bayer can cause severe health risks, including a rare form of cancer.

These lawsuits allege that Monsanto should have warned people about the cancer risk by placing the appropriate labels on their products. However, Monsanto reframed from placing on these labels, failing to inform people of the associated dangers of using their products. Due to the escalating medical costs to treat this cancer and the link that their product is the cause, people are suing the company for damages.

Roundup and Lymphoma

Around the world, people use weed killers in their yards and on crops to deal with stubborn and invasive plants. Some weed killers, such as Roundup, contain glyphosate which is an herbicide chemical that attacks the roots of the weeds and kills them. This popular herbicide has been used in all types of agricultural industries including farming and landscaping. In addition, individual homeowners can purchase Roundup directly through their home improvement stores to treat their own lawns.

However, thousands of people are filing glyphosate lawsuit claims alleging that this chemical causes non-Hodgkin’s lymphoma. Non-Hodgkin’s lymphoma is a type of rare cancer that impacts the immune system’s lymph tissue located in the spleen, digestive tract, bone marrow, lymph nodes, tonsils, adenoids, and thymus areas. The cancer cells can grow slowly or quickly and can lead to weakened immune systems, frequent infections and possible death if left untreated.

The symptoms for lymphoma can vary as people can experience shortness of breath, swollen lymph nodes, fatigue, chest pain, bruising, weakness, wheezing, swollen abdomen and fever. There has also been independent research trying to determine if there is a possible link between the glyphosate used in products like Roundup and autism in children. The non-Hodgkin’s lymphoma cancer is treatable and there is a 5 to 10-year survival rate between 69% to 59% respectively.

How You May Be Impacted

You may have recently discovered that you have a type of non-Hodgkin’s lymphoma cancer yet don’t fall into any of the other common risk factors for this disease. However, you may have been a constant user of the Roundup weed killer product for several years. During this constant exposure where the herbicide touched the skin, was inhaled or was accidentally ingested, the glyphosate affected your immune system and led to you contracting lymphoma, or you were pregnant as your child developed autism from Roundup.

If you work for a landscaping or agricultural company that uses herbicides, you may have been constantly exposed to the glyphosate in Roundup products. In addition, regular homeowners may also have been exposed on a yearly basis to this chemical when treating their yards and flowerbeds. If you have any of the mentioned symptoms, seeking medical attention immediately could help the doctors detect this rare cancer so you can begin treatment.

Roundup Cancer Lawsuit Settlements

In the state of California in the United States, three legal cases have found Monsanto liable for damages caused by their Roundup products. For the first case back in August of 2018, the state court awarded a groundskeeper $289 million (the amount was later reduced to $78 million) after a ruling that Roundup caused his cancer. In March 2019, a second glyphosate lawsuit was ruled in the plaintiff’s favor as he won $80 million in damages because he had used Roundup on his property.

Recently, a third case was decided on May 13, 2019. A married couple claimed that using the herbicide caused their non-Hodgkin’s lymphoma. They were awarded $2 billion in punitive damages and $55 million in compensatory damages.

Mass Tort Claim: Monsanto Lawsuit Roundup

Many of the plaintiffs’ glyphosate lawsuit claims against Roundup fall under the legal case of strict liability. Strict liability focuses on proving that the company knew or should have known about a product defect and taken the necessary precautions of fixing the issue or warning the public about the problem before they used the product. In these cases, many plaintiffs’ claim that Monsanto should have properly warned people about the risks linking glyphosate used in Roundup to the increased risks of developing rare cancers.

Due to Monsanto failing to inform the public about the risks of the main ingredient in their herbicide, or taking action to use a less toxic chemical, many juries are siding with the plaintiffs in these cases. The Roundup product currently does not have a cancer warning label as is still being sold in stores. As the number of non-Hodgkin’s lymphoma cases increases, the lawsuits are putting added pressures on the company that may lead them to out-of-court settlements for the remaining lawsuits.
