The Honourable Justice Sutherland reserved his decision. We will provide an update with the outcome of the certification motion when the decisions becomes available.

December 2023:

We write to provide you with a further update beyond the update provided in July 2023. We are working towards a certification motion, which has been scheduled for the first week of spring 2024. To date, we have served opposing counsel with our Notice of Motion and have completed the cross examinations of the parties.

We write to provide you with a further update beyond the update provided in March 2023. We are working towards a certification motion, which has not yet been scheduled. For your information, a certification motion is where the court allows us to proceed as a class action. To date, we have served opposing counsel with our Notice of Motion and are in the midst of completing cross-examinations of both parties.
