About the Class Action / Mass Tort and Compensation

The claim alleges that Amazon breached employment laws by failing to pay delivery drivers under the Employment Standards Act (this includes minimum wage, overtime pay and statutory holiday premiums) since 2016. 

Amazon employs delivery drivers through intermediaries known as Delivery Service Providers. However, Amazon remains the employer or common employer of all Amazon delivery drivers in Canada and remains responsible for complying with Canadian employment laws and ensuring its delivery drivers are properly compensated.

Updates (Related to the Class Action / Mass Tort)

September 2024:

The Ontario Superior Court of Justice granted Amazonโ€™s motion to stay and dismissed the Plaintiffโ€™s motion for certification. The Plaintiff is appealing the decision and a new hearing date has been set for February 12, 2025 before the Court of Appeal for Ontario.

June 2024:

We write to provide you with an update further to the update provided in December 2023. As you are aware, we have formed a partnership with the law firm, Sotos LLP. The Ontario Superior Court of Justice granted Amazonโ€™s motion to stay and dismissed the Plaintiffโ€™s motion for certification. The Plaintiff is appealing the decision and a hearing before the Court of Appeal for Ontario is scheduled to be heard on June 10, 2024.

December 2023:

We write to provide you with an update. We have formed a partnership with the law firm, Sotos LLP. A certification hearing was heard on May 9, 10, and 11, 2023. The action was not certified, however, the decision is currently being appealed. We will provide an update when one is available.

July 2023:

We write to provide you with an update. We have formed a partnership with the law firm, Sotos LLP. A certification hearing was heard on May 9, 10, and 11, 2023. For your information, a certification motion is where the court allows us to proceed as a class action. We will provide an update when the certification hearing decision is made available.

September 2021:

We are currently canvassing dates with opposing counsel for our next court appearance. We will be providing another update following that court appearance.
