An experienced personal injury lawyer will have the right tools necessary and the experience to handle your claim. Buy do not mistake experience for somebody who is knowledgeable. Although experience goes a long way, the number of years called to the bar does not always ensure that you are getting the best representation possible.

For example, myself, Isaac Zisckind and partner Sandra Zisckind spent the first couple years practicing defence and essentially looked for ways to deny claims. We were able to gain experience in litigation from a different perspective, from the insurer’s perspective, understanding their risks and concerns going forward, not just the plaintiff’s. Once Sandra and I switched over to doing strictly plaintiff personal injury law, we were able to use the experience and knowledge from the insurance defence side to ensure that all of our clients are getting proper representation, best settlements, and highest settlements or outcomes possible.

So when discussing experience, the number of years called to the Bar is not the only factor. It should be knowledge and what kind of experience that person had. For example, how many times has that lawyer went to trial? What is their success rate? How many types of cases did they handle like yours? What are the percentages of claims that get settled? Are you specialized in this area of law?

Furthermore, there are a lot of lawyers out there that will dabble in different areas. Insurance law is very complicated and has gotten more complicated over the years. There are different schemes such as accident benefits, (SABS) the “Insurance Act”, motor vehicle accident laws, thresholds, deductibles and other legal terms that lawyers must be aware of when they are representing their clients. For example, most people in the community when they buy insurance assume that they are completely taken care of by the other insurer’s party if an accident occurs, but that is incorrect. In fact, most people that come to our office do not know that the majority of the time one must apply through their own accident benefit insurer for benefits such as income replacement, physiotherapy, housekeeping, attendant care and caregiving benefits. Only after those benefits are exhausted may you seek from the third party or the defendant damages for things such as income replacement, physiotherapy, etc. The majority of time when you sue a third party defendant and their insurer, it is usually because you are suing them for general pain and suffering plus any out-of-pocket expenses or med rehab or income loss that your own insurer will not pay for.

Furthermore, for motor vehicle accidents in Ontario, did you know that you could be subject to a $30,000 deductible if you go to trial? Most people think that if they are awarded $50,000 or $60,000 by a jury or a judge at trial for pain and suffering in a motor vehicle accident, they receive that full amount. This is not the case. There is an actual $30,000 deductible that applies to motor vehicle accidents in Ontario at trial for any awards under $100,000. Therefore, if you get awarded $100,000 at trial by a jury, the judge then would order that the defendant only pay $70,000. Just as if you were awarded $50,000 at trial, you would end up with $20,000. This goes to the point that the best personal injury lawyer is one that understands personal injury law in Ontario.

Just because you have been referred by a friend or somebody at the hospital to a personal injury lawyer does not mean that they are the best. The truth is, reputation and fit is very important. You have to like the lawyer that you are with as you are going to be entering into a relationship with that lawyer for the next 3 to 4 years. Lawsuits are not a simple thing.
