Furthermore, for motor vehicle accidents in Ontario, did you know that you could be subject to a $30,000 deductible if you go to trial? Most people think that if they are awarded $50,000 or $60,000 by a jury or a judge at trial for pain and suffering in a motor vehicle accident, they receive that full amount. This is not the case. There is an actual $30,000 deductible that applies to motor vehicle accidents in Ontario at trial for any awards under $100,000. Therefore, if you get awarded $100,000 at trial by a jury, the judge then would order that the defendant only pay $70,000. Just as if you were awarded $50,000 at trial, you would end up with $20,000. This goes to the point that the best personal injury lawyer is one that understands personal injury law in Ontario.
