Publication: insauga | Published: October 6, 2026 | Format: Sponsored feature | Subject: Jeremy Syrtash, Head of Medical Malpractice Litigation

insauga has published a feature on Jeremy Syrtash, Head of Medical Malpractice Litigation at Diamond & Diamond Lawyers LLP. The piece marks his recognition in Best Lawyers: Ones to Watch in Canada™ for Health Care Law in four consecutive editions, from 2024 through 2027, and looks at the medical malpractice work behind it.

What the feature covers

The insauga profile traces Jeremy’s path into medical malpractice litigation, from his undergraduate degree at Yeshiva University and his Juris Doctor from the University of Ottawa to his call to the Ontario Bar in 2014. It describes more than a decade of work as counsel and co-counsel on medical malpractice trials across Canada, many of them involving paediatric and obstetrical negligence, along with wrongful death claims brought by families against physicians, nurses and midwives.

The feature also highlights his earlier work as a personal support worker, which gave him first-hand insight into the daily realities of people with disabilities who rely on ongoing care. It notes his appearances before the Ontario Court of Appeal, the Ontario Superior Court of Justice, and the Courts of King’s Bench in Alberta, Saskatchewan and Manitoba.

Four editions of peer recognition

Best Lawyers recognition is decided by other lawyers. Practising lawyers complete a confidential survey assessing peers who work in the same practice area and region, and no firm can pay to be included. Best Lawyers: Ones to Watch is a separate recognition for lawyers earlier in their careers whose work has been identified by their peers.

Each recognition attaches to a named practice area, a country and an edition year, and it is reassessed every year. Jeremy has been recognized for Health Care Law in Canada in the 2024, 2025, 2026 and 2027 editions.

Why medical malpractice claims are complex

Harm in hospital is more common than many people expect. According to the Canadian Institute for Health Information, about 1 in 17 acute care hospital stays in Canada involves at least one harmful event, and many of those events are preventable.

Not every bad outcome is negligence, though. To succeed in a medical malpractice claim, a patient generally has to show two things. First, the care they received fell below the standard expected of a reasonably careful health care provider in the same circumstances. Second, that failure caused their injury. Canadian courts apply the “but for” test for causation, set out by the Supreme Court of Canada in Clements v. Clements, 2012 SCC 32.

Take a delayed cancer diagnosis as an example. It is not enough to show that a test result was missed. The patient must also show that, but for the delay, their outcome would likely have been different, which usually means comparing medical records, timelines and opinions from qualified physicians. Claims involving birth injuries, surgical errors and medication errors raise the same two questions, often across thousands of pages of records.
