Justice Morgan certified the class action in December 2022. The Ontario Superior Court of Justice recently approved the Notice of Certification and issued a Certification Order. Pursuant to the Notice, all class members who plan to pursue individual claims must opt out of the class action by no later than June 30, 2025. English versions of the notice can be found here (long form) and here (short form). Please ensure that you read the notice carefully. We are currently preparing the opt out forms to ensure that those who signed up with Diamond and Diamond are opted out of the class action before June 30th.
As a reminder, Diamond and Diamond is pursuing these claims as a mass tort, meaning that those who signed up with us will be opted out of the class action so we can launch individual claims on your behalf.
