Recall Havoc
With all the news on the GM recall we are getting panicked and frantic calls. So let me be clear and explain. Just because your car was subject to a recall and you were involved in an accident it doesn’t mean that you have a case against GM or any other car manufacturer.
In order to be successful in these types of cases you have to prove the defect or malfunction is what caused or contributed to your accident. Not an easy feat. You need an engineer to examine the car in depth and examine the data in your car’s internal computer.
The GM recall is sad. There have been 13 deaths linked to malfunctions in their GM cars. We have to remember that all of these corporations make business decisions. Sometimes the decisions cost lives. Sometimes they adversely affect the public. At the end of the day it’s all business for them.
The people we need to look to for more stringent legislation on corporations that make these horrific decisions or insurance companies that unfairly treat their clients is our government. We need punitive measures put in place as deterrents. Our government needs to stop being afraid that big business will pack their bags and go home.
The U.S. has aggressive bad faith legislation and yet insurance companies continue to thrive. They also stood up for victim’s rights and refused to enter into a treaty limiting victim’s compensation for injuries relating to airline accidents. Let’s look to those mandated to protect the public interest.
